The Medical College of Wisconsin, a private, not-for-profit health university which includes one of the largest medical schools in the United States along with one of the largest faculty practices, is seeking an experienced attorney to serve as their next Associate General Counsel-Labor and Employment/Student and Academic Affairs.

This role will provide high-level legal support through advising and guiding MCW on complex and routine matters related to labor and employment and student/academic affairs, including matters involving MCW’s clinical partners, such as Froedtert Health, Children’s Wisconsin, and the Zablocki VA.  Independent judgment/initiative required with strong writing and communication skills. Responsibilities:

  • Provides legal representation with respect to employee / labor law including drafting and negotiation of non-compete agreements, physician employment agreements, and severance agreements.
  • Coordinates and manages employment and educational investigations and claims, including those involving the EEOC, ADEA, Title VII, Title IX, FERPA and ADA. Responds to allegations and complaints, litigates and/or manages outside legal counsel.
  • Provides key legal support on employment risk issues, including compensation, immigration, and compliance with FMLA and other employment and benefits laws (such as ERISA and wage/hour laws).
  • Advises academic leadership on higher education law, including tenure, FERPA compliance, Clery Act, admissions, financial aid/scholarship programming, student conduct/affairs and academic program administration,
  • Leads drafting and implementation of agreements with educational affiliate partners, including joint program, dual credit and articulation agreements. Coordinates legal compliance with respect to international programs, distance learning offerings and enrollment of students learning domestically and abroad.
  • Assists with institutional accreditation efforts, academic operations and programming, including educational policies, accreditation documents and Student Handbooks
  • Coordinates and manages relations with OCR, Department of Education, and leads response to any inquiries and/or complaints.
  • Reviews contracts and other legal obligations of MCW and advises of legal risks.
  • Advises on legislative and other important legal developments that could affect MCW and its operations; performs research and drafts policies and legal documents; and provides opinions on a broad range of legal matters.
  • Deals regularly with officers, senior associate deans and department chairs of the organization, faculty, and top-level management officials and senior attorneys in other organizations.
  • Carries out assignments independently and makes final legal determination in matters of substantial impact.
  • Perform other duties and responsibilities as assigned.

    Minimum Qualifications:

  • Education: Advanced Degree: J.D. or LL.M from an accredited law school.
  • Experience: 10 years of relevant experience, with a strong background in labor and employment, education, student affairs and not-for-profit corporations.
  • Licenses/Certifications: Member of the Wisconsin Bar, or the ability to obtain in-house counsel designation.  
  • Demonstrated leadership and managerial skills, with excellent business acumen, high ethical standards, and a commitment to legal and regulatory compliance.

    Preferred Qualifications:

  • Previous experience in a senior legal role or as in-house counsel is preferred.
