The Law of Higher Education

NACUA, in cooperation with Professors Kaplin, Lee, Hutchens and Rooksby and with Jossey-Bass, Inc., has created this web page as a service to its members and other users of The Law of Higher Education, 6th Edition (the two-volume treatise, published in April of 2019) and related volumes: the Student Version of The Law of Higher Education, 6th Edition,(published in April of 2020) and the 2nd edition of A Legal Guide for Student Affairs Professionals (2009). Descriptions of these publications are set out immediately below, followed by links to further information about these works. There are also links to the authors’ Updates on recent developments in higher education law; to information about the authors’ supplemental volume of teaching materials (keyed to the Student Version); and to the authors’ Instructor’s Manual for the Student Version -- along with suggestions for how to use these books and resources for instructional purposes.

The Law of Higher Education, 6th Edition: The Two-Volume Treatise

The Law of Higher EducationThe Law of Higher Education, 6th Edition, by William Kaplin, Barbara Lee, Neal Hutchens and Jacob Rooksby was published by Jossey-Bass, Inc. in April 2019. This two-volume work updates and expands the topics and analyses that were included in the Fifth Edition. It also incorporates the latest major developments in higher education law and is current through June 2018, although many sections are current through December, 2018. The treatise is available at this website.

 

 

 

The Law of Higher Education, 6th Edition: Student Version

This paperback student version of the Kaplin, Lee, Hutchens and Rooksby treatise was published in April 2020 and is available from Jossey-Bass.

A paperback student version of Kaplin, Lee, Hutchens and Rooksby’s treatise is available from Jossey-Bass, Inc. This text, The Law of Higher Education Sixth Edition: Student Version, contains all the material from the two-volume treatise that is of most interest to instructors and students, along with various enhancements that the authors have added specifically to facilitate the book’s use for instructional purposes. The student edition is available here.

Instructors may wish to use, in addition, the Updates to the Student Version that are linked to this webpage, and the teaching materials that the authors have prepared (Cases, Problems, and Materials) keyed to the Student Version of the fifth edition; and the Instructors’ Manual for the Student Version.

A Legal Guide for Student Affairs Professionals, 2nd Edition

An adaptation of Kaplin and Lee’s treatise, specifically for student affairs professionals, was published by Jossey-Bass, Inc. in the spring of 2009. This book, A Legal Guide for Student Affairs Professionals, 2nd edition, contains all the material from the earlier two-volume work that is pertinent to student affairs – updated, reorganized, and re-edited to maximize usefulness for these professionals. It is available on the Jossey-Bass website. In 2011 Jossey-Bass also published The Supplement to A Legal Guide for Student Affairs Professionals. The Supplement is also available from the Jossey-Bass website

Which Materials to Use for Teaching?

  • Instructors using the Student Version for the Sixth Edition of the treatise as a course text should request the Cases, Problems, and Materials for Use with The Law of Higher Education SIxth Edition: Student Version (follow link above).

  • Instructors who are using the Student Version as a course text, but have purchased the two-volume treatise for their own use as a course resource, should request the Cases, Problems, and Materials for the Student Version. Because the Student Version is shorter, its chapters and section numbers differ from those in the treatise, and the materials in the CPM for the Student Version are keyed to the chapters and section numbers in the Student Version. To assist instructors (and students) using the treatise as an additional resource, the authors have provided a Crosswalk from the Student Version to the Sixth Edition of the treatise (see links to additional resources, above). The Crosswalk also appears in the front of the Student Version.

  • For instructors who choose to use the Student Affairs book as a course text, there is no CPM keyed specifically to that book. Such instructors, however, may obtain a copy of the CPM for the Student Version and adapt it for use with the Student Affairs book.  A review of the table of contents of the CPM for the Student Version should reveal edited cases, notes and questions, problems, and large scale problem exercises that could be used selectively in conjunction with the Student Affairs text.  A Supplement to the Student Affairs book was published by Jossey-Bass in 2011 and is available from the publisher.
