Position Summary | This role has a reporting relationship to the Senior Associate General Counsel, and SVP General Counsel and Corporate Secretary (“General Counsel”). The Associate General Counsel – Labor and Employment Litigation Management, Student Service Attorney (“Associate General Counsel”) plays a crucial role in providing legal guidance and support to the administrative and business operations of Morehouse School of Medicine and the faculty practice plan, Morehouse Healthcare. The responsibilities of the Associate General Counsel include supporting multiple business units by providing legal services as outlined below. Also, the responsibilities for the Associate General Counsel include assisting with the management of outside counsel. The ideal candidate will possess a strong background in litigation with a focus on labor and employment law, have exceptionally strong analytical, problem-solving, and research skills, and be able to work independently and collaboratively.
Primary Responsibilities: - Under the management and supervision of the Senior Associate General Counsel and the General Counsel, the responsibilities of the Associate General Counsel will include but not be limited to functioning in the following areas:
Labor and Employment Litigation Management
- Conduct legal research and provide legal opinions on employment laws to include but not be limited to Title VII, ADA, ADEA, Rehab Act Section 504, FMLA, FLSA, ERISA, Equal Pay Act, Wage and Hour Laws, Workers Compensation, COBRA
- Conduct legal review of draft employment-related agreements, to include but not be limited to severance, separation, restrictive covenant, retention, and other employment-related agreements
- Monitor new laws, regulations and decisions affecting the substantive legal areas above and provide strategic advice to company leadership
- Institution wide training events on employment law, litigation, and compliance related matters
- Conduct legal review of employment-related aspects of mergers, acquisitions and divestitures, and related integration efforts
- Assist with the support strategic HR projects, pay equity analysis, and employment aspects of mergers, acquisitions, divestitures, restructuring and outsourcing.
- Conduct legal review of Institution’s responses to demand letters, agency matters, government-initiated inquiries, and relevant audits
- Manage relationships and costs with outside counsel handling employment litigation and advisory matters
- Partner with outside counsel in the drafting of and/or review of documents, including correspondence with opposing counsel, EEO position statements, mediation statements, and pleadings
- Respond to or assist outside counsel with responding to inquiries, charges, or complaints registered by or with external regulatory and law enforcement agencies, to include: conducting or assisting with internal investigations; marshalling evidence for reports, investigative responses, and discovery; and assisting in the development and articulation of Institution positions and responses in consultation with the General Counsel, Senior Associate General Counsel and other appropriate Institution administrators
Student Affairs/Services Advisement
- Conduct legal research and provide memo or advisement on issues that intersect with federal laws to include but not be limited to FERPA, Title VI, Title IX, ADA, Section 504 of Rehabilitation Act, FHA, HUD
- Provide Institution’s Office of Student Affairs with relevel legal updates and advisory service on questions of law or compliance
- Provide Institution’s Office of Admissions with relevel legal updates and advisory service on questions of law or compliance
- Provide Institution’s Office of Financial Aid with relevel legal updates and advisory service on questions of law or compliance
- Provide Institution’s Office of Institutional Advancement with relevant legal updates and advisory service in relation to scholarships, fellowships, endowments
- Support training events on legal requirements or updates relevant to academic programs and activities
Management of Non-Party Request
- Prepare written responses to document requests such as subpoenas, discovery, requests including preparing search terms for electronic searches and reviewing documents for redaction
- Defend Non-Party Depositions
Knowledge, Skills, and Abilities:
- Skilled legal professional with 10+ years of experience and a track record of success
- Experience in litigation with a focus on labor and employment law
- Experience with dispute resolution
- Expert in leading overall business operations by providing legal guidance to leadership responsible for developing strategic relationships and execution of institution wide goals
- Experience motivating and leading a team
- High degree of accuracy, good judgement, and decision-making
- Demonstrated record of integrity and accountability
- Demonstrated communication skills that include excellent organizational, people skills, and strong verbal, and written communication skills
- Ability to work in a high-volume environment
- Excellent time management skills and organizational abilities
- Ability to manage sensitive and confidential matters appropriately
- Advanced knowledge of Excel, PowerPoint, and other Microsoft Office programs
- Familiarity with BoardEffect (Board Portal) and Agiloft (Contract Lifecycle Management System)
