Complaints and Investigations Involving Allegations of Misconduct by Third Parties

Some of the most challenging complaints and investigations at colleges and universities involve allegations of misconduct by third parties.  Because they are outside the nucleus of core faculty, employees, and students at higher education institutions, third party allegations can strain the policies and processes in place to address these complaints, since the policies were often designed for incidents involving only those within the campus community.  This type of complaint and ensuing investigation typically calls for a higher level of creativity, flexibility, and attention on the part of counsel, investigators, and administrator colleagues.  Understanding the nuanced approach required to handle complaints and investigations involving third parties is important to ensure that the concerns raised by complainants are adequately addressed, that the institution fulfills all of its legal obligations, and that the campus remains a safe and supportive place to learn and work.
