Pregnancy Discrimination Updates

Recent developments have put a spotlight on higher education institutions’ obligations related to pregnancy discrimination and reproductive health. The Department of Education’s Notice of Proposed Rulemaking on Title IX, published in July 2022, contains provisions that together seek to “clarify a recipient's obligations to students and employees who are pregnant or experiencing pregnancy-related conditions.”  At the same time, the Supreme Court’s decision in Dobbs v. Jackson Women's Health Organization has cast a pall of uncertainty over institutions’ actions and communications on topics at the intersection of pregnancy discrimination and reproductive healthcare for students, faculty, and employees.
