The Changing Landscape of Higher Education Discrimination Law: Current and Future Challenges

Colleges and universities grapple continuously with the changing nature of higher education discrimination law.  In recent years, the activism of those seeking greater protections and those opposing expansion of protections have left institutions trying to create welcoming climates at the same time they promote free exchange of ideas and preserve academic freedom and speech rights.  Institutions wanting to create safe campuses and fulfill their obligations under Title IX face litigation from respondents as they attempt to resolve claims of sexual misconduct.  Federal action to prohibit transgender discrimination and to require increased web accessibility remains uncertain as a new administration assumes control of federal agencies.

This in-depth workshop will examine key issues and developments to help you advise and represent your higher education clients.  Sessions will combine practical strategies and advice on how institutions can avoid discrimination claims and liability.

Sessions will include:

  • Top trends and emerging issues in higher education discrimination law
  • Evolving legal challenges impacting transgender students and employees
  • Practice tips for dealing with new and ongoing investigations during the transition of administrations

In addition to regular sessions, discussion groups will allow participants to exchange ideas, pose questions, and share experiences and solutions with colleagues in a small-group setting. Discussion group topics will include exploring different investigative models and obligations related to study abroad and foreign students on campus.
