Developments in Title IX-Part 1:
Release of New Information by the Department of Education

On September 7, 2017, Secretary of Education Betsy DeVos announced that the Department will launch a notice and comment period to develop regulations under Title IX that address campus sexual misconduct. On September 22, 2017, the Department announced that it was withdrawing the existing 2011 Dear Colleague Letter and the 2014 guidance on sexual misconduct on campus; this announcement is available here. At the same time, the Department released a document in a question-and-answer format providing information to colleges and universities about the Department’s Title IX enforcement approach during the time the new regulations are being developed. To help NACUA members understand these developments and what they mean for their campuses, NACUA will offer a free 45-minute “Briefing” on Tuesday, September 26, 2017 from 2:00 to 2:45 p.m. (EDT). On this audio-only call, Pam Bernard, Vice President and General Counsel at Duke University, Jerry Blakemore, General Counsel at the University of North Carolina at Greensboro, and Amy Foerster, General Counsel and Chief of Staff at Bucknell University, will outline these significant developments and explain their impact on colleges and universities. NACUA will also be offering a second NACUA Briefing on Thursday, September 28, from 2:00 to 3:00 p.m. EDT. We are pleased to announce that Candice Jackson, Acting Assistant Secretary for Civil Rights at the Department of Education, has agreed to participate in this second Briefing.
