While reporting to the General Counsel and the Vice President, Human Resources or designee, the Assistant General Counsel manages the labor relations function as well as provides guidance to the employee relations function of the College. Directs labor relations programs in the area of contract negotiations and administration, employment law compliance, employment policy development, faculty complaints, grievances, and employment-related legal actions. Serves as advisor to senior management on labor issues to maintain efficient labor and employee relations in support of the College’s goals and objectives.
The Assistant General Counsel is responsible for traditional management-side labor issues including collective bargaining agreement administration, representing and advising management in connection with union representations campaigns, collective bargaining negotiations, labor arbitrations, and proceedings before the National Labor Relations Board, Equal Employment Opportunity Commission, Illinois Department of Human Rights, and the Department of Labor (state and federal).
Duties of Position:
- Responsible for unionized workforce contracts and contract interpretation, as well as relations with relevant labor organizations concerning terms and conditions of employment.
- Serves as chief negotiator for the College and hearing Officer for grievances and arbitration processes of the purpose for representing the College's interest in labor negotiations and/or resolving grievance issues.
- Coordinates with Vice President, Human Resources in formulating labor relations planning and strategies.
- Administers collective bargaining by reviewing issues and problems that occurred during the term of an agreement to determine where changes need to be made, meeting with management staff to discuss problems that need to be addressed in negotiations, preparing recommendation of proposed changes to contractual language, etc.
- Analyzes potential impact of contract provisions and advises senior management.
- Interprets contract language, Community College Act and employment regulations for the purpose of ensuring compliance with college, local state and federal requirements.
- Collaborates and provides assistance to administrators and managers regarding contract interpretation for the purpose of ensuring compliance with established practices and regulations.
- Administers provisions of labor and/or professional association negotiated agreements for the purpose of maintaining a fair and positive relationship with various labor unions and ensuring compliance with all relevant local, state and federal regulations.
- Manages matters before the NLRB and courts of law, including defense of unfair labor practice charges, failure to bargain in good faith, conduct alleged to interfere with employee rights, unit and representation disputes, and other alleged violations of the National Labor Relations Act.
- Manages employment-related claims and lawsuits, including claims brought under the ADEA, Title VII, and other relevant federal and state laws.
- Must have a JD degree from an accredited law school and license to practice law.
- Substantive experience in labor issues and employment law required.
- Proven track record as a chief spokesperson in negotiations representing management required. Experience resolving grievances, interpreting union contracts, managing multiple contract and negotiation targeted outcomes across portfolio of agreements. Litigation experience in employment cases, NLRB proceedings, administrative hearings and arbitration required.
- Strong written, analytical, verbal and presentation skills.
- Experience as in-house counsel, particularly in an institution of higher education preferred.
- Previous experience working with ethics, compliance, and internal investigations related to prosecution or regulatory compliance preferred.
- Experience managing and addressing employee relations issues including EEO charges, discrimination charges, etc. preferred.
