FN44.   School Official Using Access to Education Records without Legitimate Educational Interest; Limits of Health or Safety Emergency Exception (FPCO letter to J. Chris Toe, Strayer University, March 11, 2005).  This “exception” does not apply, however, if the employee gained the personal knowledge in the course of making an official determination that has been or will be recorded.  For example, a faculty member who awarded a student a grade or a judicial affairs officer who suspended a student cannot disclose that information even though it is based on “personal knowledge”.  See FPCO Letter to Elvira Strehle-Henson, University of Colorado at Boulder, February 11, 2005.
