R ecent events across the country have highlighted the importance of institutional compliance with the Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act, commonly referred to as the Clery Act. With the goal of promoting campus safety and informing prospective students and employees of the frequency of certain crimes at individual institutions, the Act, its implementing regulations and sub-regulatory guidance documents (including the 304-page Department of Education Handbook for Campus Safety and Security Reporting) impose a daunting array of compliance obligations in terms of gathering, recording, and reporting selected crime data, publication of required statements and policies, and early warnings or emergency notifications of threats to other members of the campus community. The Department of Education has also increased the frequency of Clery Act compliance reviews at institutions across the country. These reviews are lengthy and detailed in scope, requiring the collection and review of documents and data, and interviews with numerous campus officials with Clery Act responsibilities. Violations of the Clery Act can result in severe monetary penalties, as well as adverse publicity for the affected institutions.
This program will review key compliance obligations under the Clery Act, focusing on violations commonly cited by the Department in its reviews, as well as difficult or complicated compliance issues. The program assumes familiarity with the Clery Act, its basic concepts and compliance requirements. The program will cover:
- • Issues associated with the geographic reporting of Clery Act crimes, especially reporting obligations of non-campus, separate campus and branch campus sites
- • Campus security authorities, including identification, training, and gathering of crime data; as well as gathering of data from local law enforcement agencies
- • Sex offenses, including requirements under both the Clery Act and the April 4, 2011 OCR “Dear Colleague” Letter
- • Timely warnings and emergency notifications
- • Annual Security Report compliance issues
The program will conclude with a discussion of Clery Act compliance reviews, including what to expect from the Department of Education, how to prepare for the review, and commonly cited errors from recent audits.
