Program Description

Recent legislative and regulatory developments made significant changes to both the ADA and the FMLA. The ADA Amendments Act of 2008 reverses several Supreme Court decisions and will make disposing of ADA cases prior to trial much more challenging. College and university counsel need to understand these changes and how they will impact ADA compliance and litigation on their campuses.

Proposed FMLA regulations are scheduled to be finalized in November. These regulations include a number of changes that could affect when and how college and university employees can take leave under the FMLA. The FMLA has also been amended to include provisions that provide leave for relatives caring for an injured servicemember.

This program will cover the relevant statutory and regulatory changes including:

  • Overview of the significant changes to the ADA
  • New or pending FMLA regulations

  • Other legal developments (Department of Justice proposed ADA regulations, the Lilly Ledbetter Fair Pay Act)
