Once upon a time, attorneys spent hours poring over documents in response to discovery requests.  Now, discovery requests often focus on electronically stored information or “ESI.”  According to information experts, as much as 90 percent of all documents are created and maintained in electronic formats.  When faced with a discovery request, counsel must now determine not only what information is relevant, but where that information is located and how and when to preserve the information.  This is even more challenging in the decentralized setting of a college or university.  Recent case law makes clear the failure to preserve, protect and produce information can lead to stringent sanctions.
