REQUIREMENTS:

Required:

Position Description

Qualifications:

Position Duties

Qualifications

The Compliance Officer/Investigator reports to the Director Equal Opportunity/ADA/Title IX Officer. This position serves as the primary Investigator for complaints of harassment, sexual misconduct and discrimination made by students, faculty and staff pursuant to all applicable University Policies, including the Policy on Prohibited Harassment, Including Sexual Misconduct, and Discrimination. The Investigator will assist the University of North Carolina at Chapel Hill in achieving its goals of providing an open, diverse and inclusive learning and working environment by conducting prompt, thorough and objective investigations of complaints, by providing educational training programs to various constituencies within the University, and by monitoring the University’s compliance with Title IX, Title VII and other federal and state statues and regulatory requirements.
Principal Functions:
1. 30 % The Compliance Officer/Investigator conducts prompt, thorough, objective and
confidential investigations of complaints of harassment, including sexual misconduct, and discrimination made by students, employees and third parties. The position is responsible for interviewing relevant parties, identifying, collecting, preserving and analyzing evidence and documentation related to the complaint being investigated. Prepares accurate, timely, detailed reports of findings and conclusions. Maintains case files of complaints and their disposition. Analyze and prepare data/reports of complaint activity for use in ongoing university assessment and for responding to annual reporting requirements. Monitors compliance with all procedural and substantive requirements and timelines outlined in applicable university policies, including the Policy of Prohibited Harassment, Including Sexual Misconduct, and Discrimination and other grievance policies and procedures.
The incumbent works with issues, complaints and requests related to Title IX, Title VII, Title VI, the Americans with Disabilities Act, Section 504/503 and the Rehabilitation Act, and other applicable equal opportunity and non-discrimination laws and regulations.
2. 30 % Coordinates with the Student Complaint Coordinator in Student Affairs and the Grievance Coordinator in the Office of Human Resources in the investigation and resolution of complaints. Assures appropriate coordination with University Counsel and other university departments as appropriate. Provides consultation and information regarding complaint procedures to potential complainants.
3. 10% Assist in the design, development, and implementation of educational programs for the university community relating to discrimination, sexual harassment and sexual misconduct prevention. Assist in the design of brochures and course materials for educational programs.
4. 5% Researches and stays abreast of regulations and statutes. Determine impact of implementation of new regulations and statues and required notifications, changes, and training. Develops strategies for communicating and implementing required changes.
5. 25% Respond to charges from external investigating agencies, including the EEOC, the North Carolina Office of Administrative Hearings, OFCCP and the Department of Education on behalf of the Office. Interpret and review rules, policies, practices, guidelines, and procedures governing faculty, staff and student complaint and grievance procedures. Research and provide analysis, including credibility assessments, and develop reports of findings and recommendations.
Education Requirements:
Master’s degree in business/human resources or a related discipline is required. Juris Doctorate or equivalent from an accredited law school can be substituted for a Master’s.

The Executive Counsel provides legal support to the Vice Presidents, Senior Administrators, Deans, Department Chairpersons and Directors of College programs, units and College faculty.
Responsibilities include, but are not limited to, the following:
- Responsible for the administration and interpretation of the University Bylaws, University and College policies and procedures, College governance charter, and various collective bargaining agreements.
- Handles employee grievances and disciplinary proceedings and serves as appeals agent for student disciplinary process; advocates the College's position at appeal hearings.
- Works with attorneys in CUNY's Office of the General Counsel and Office of Human Resource Management and acts as the College's representative at arbitration.
- Investigates complaints filed from outside agencies; provides records, files and documents required at legal inquiries and proceedings; prepares or reviews subpoenas and requests for information under the Public Information Act, contracts and affiliation agreements entered into by the College; assists in proceedings before federal and state courts and administrative agencies; and ensures College compliance with federal, state and local laws and regulations.

Appalachian State University invites applications for the position of Assistant Director of Equity, Diversity and Compliance. Under the direction of the Director of Equity, Diversity and Compliance, the Assistant Director will draft university policies; conduct investigations of complaints of discrimination and harassment, including student sexual misconduct cases; advise students, faculty, staff and administrators on equity matters; prepare the university’s annual Affirmative Action Plans; develop and deliver educational opportunities for students and employees on equity matters; enhance and manage mediations for faculty and administrators; advise search committees; and collaborate with campus constituencies on initiatives involving diversity and inclusion. The Assistant Director serves as the Director’s representative when necessary.
Minimum Qualifications Required:
- Bachelor’s Degree
- Experience investigating harassment and discrimination complaints in the workplace
- Knowledge of Affirmative Action regulations, policies and practices
- Strong workshop development and presentation skills
- Knowledge of best practices for advancing diversity and inclusion
- Demonstrated communication, analytical and research skills
- Ability to work with diverse constituencies in a dynamic university environment
- Strong computer skills
Preferred Qualifications:
- Master’s Degree or Juris Doctorate
- Certification as a mediator
- Experience investigating student sexual misconduct cases

Description:
The University of Michigan, Office of the General Counsel, is seeking an attorney with experience in the areas of education law, higher education law and/or civil rights law to provide legal advice and counsel focused on student affairs. In particular, the selected candidate will have demonstrated knowledge of FERPA, Clery Act, federal financial aid, civil rights laws and/or constitutional law.
This attorney will work closely with student affairs professionals on all three University campuses, executive officers, school and college administrators, and others who provide student-related services such as the University Registrars and Financial Aid Officers. This position has an important role in protecting the University’s interests by promoting effective risk management and compliance programs related to student misconduct, accommodations for students with disabilities, student groups, club sports, crisis management planning, study abroad and international engagement. Other responsibilities will include service on University committees, policy development and review, monitoring of state and federal legislative developments, education/training, special projects, and supervision of outside counsel on student-related litigation.
Qualifications:
Qualifications include excellent academic credentials and a law degree from an accredited law school. Membership (or eligibility for membership) in the Michigan State Bar is required. This position requires a minimum of 5 years of directly related professional experience, excellent communication skills, demonstrated ability to creatively problem solve, effective relationship building skills and an interest in students and student affairs. Prior experience as in-house counsel for higher education clients is preferred. Litigation experience is also desired.
